Entry Visa to France


Appealing decisions refusing an entry visa to France


If, as indicated below, in certain cases, a refusal of an entry visa to France is not legitimate, obtaining a visa for short stay (a uniform or Schengen visa, etc.) or long stay visa is, nevertheless, in many cases, a foreigner’s right.

In effect "notwithstanding the law related to the duty to give reasons and to improve relations between the administration and the public, decisions to refuse entry visas to France, taken by diplomatic or consular authorities are not justified except in the cases where the visa is denied to a foreigner who belongs to one of the following categories and subject to consideration for the State’s security:

1°Family members of citizens of one of the European Union Member States and other States that take part in the European Economic Area agreement who are not nationals of one of these states, belong to the categories defined by order in the Council of State;

2° Spouses, children under twenty-one years old or dependent children, and ancestors of French nationals;

3° Minors living abroad, subject to a decision for full adoption for the benefit of individuals holding an approval for adoption issued by the French authorities;

4° Beneficiaries permission for family reunification;

5° Workers authorized to engage as professionals in paid employment in France (...) ".
